Organic Products Compliance
The Organic Foods Production Act (OFPA) of 1990 establishes national standards for marketing agricultural products as “organic.” Under the OFPA, the US Department of Agriculture (USDA) is authorizes to implement the National Organic Program to establish and enforce standards for “organic” foods. The National Organic Program includes standards for growing and producing organic agricultural products, including grains, fruits, vegetables, and livestock. The use of an "organic" label in the wrong context may constitute an illegal misleading food label.
The USDA requirements for the use of the term "organic" are separate from the laws and regulations that FDA enforces for foods. Food products labeled with organic claims must comply with both USDA regulations for the organic claim and FDA regulations for labeling.
